Welcome to onesnap.

These Terms of Use (“Terms”) govern your use of onesnap, including our website, applications, services, event galleries, invitation tools, and related features (collectively, the “Service”).

onesnap is operated by Throwing Eights Pty Ltd (ABN 53 670 017 802) (“Throwing Eights”, “we”, “us”, or “our”).

By creating an account, creating or joining an event, uploading content, purchasing a plan, or otherwise using onesnap, you agree to these Terms.

If you do not agree to these Terms, do not use onesnap.

1. What onesnap Is

onesnap is a private event photo-capture and photo-sharing platform that allows event hosts and guests to capture, share, view, download, and preserve memories from events such as weddings, parties, celebrations, and other private gatherings.

onesnap is designed for private events. It is not intended to operate as a public social network.

2. Eligibility

You must be at least 16 years old to create an account or use onesnap.

If you are under 18 years old, you should have permission from a parent or guardian where required by law.

Parents and guardians are responsible for supervising minors who use the Service.

3. Accounts and Event Access

You may create an account, create events, join events, upload content, and access event galleries using features made available by onesnap.

Event hosts may choose to protect events using passwords or other security features that we provide.

Anyone who obtains an event link, QR code, event code, password, or other access credentials may be able to access that event.

Event hosts are responsible for managing access to their events and deciding how event invitations are distributed.

While onesnap is designed for private events, no online service can guarantee absolute security or prevent all unauthorised access.

4. Purchases and Payments

Some features of onesnap may require payment.

Unless otherwise stated:

  • purchases are one-time purchases for the selected event or feature;
  • fees are charged in the currency displayed at checkout;
  • payments are processed by our third-party payment providers.

Except where required by law, purchases are non-refundable.

Nothing in these Terms limits any rights you may have under Australian Consumer Law or other mandatory consumer protection laws.

5. Your Content

You retain ownership of the photos, videos, comments, captions, and other content that you upload to onesnap (“Content”).

Uploading Content does not transfer copyright ownership to onesnap, the event host, or any other user.

You are responsible for the Content you upload.

By uploading Content, you represent that:

  • you own the Content or have the right to upload it;
  • your Content does not infringe the rights of another person;
  • you have obtained any permissions or consents reasonably required to share the Content;
  • your Content complies with applicable laws.

6. Licence Granted to onesnap

To operate the Service, you grant Throwing Eights and onesnap a worldwide, non-exclusive, royalty-free licence to:

  • host;
  • store;
  • copy;
  • reproduce;
  • process;
  • transmit;
  • distribute;
  • display; and
  • make technical modifications to

your Content as reasonably necessary to provide, maintain, secure, improve, and operate the Service.

This licence exists only for the purpose of operating onesnap.

We do not claim ownership of your Content.

We do not use your Content for advertising, marketing, or AI model training without your separate consent.

7. Licence Granted to Event Hosts and Participants

When you upload Content to an event, you acknowledge that the Content becomes part of that event’s shared collection.

By uploading Content to an event, you grant the event host a worldwide, non-exclusive, royalty-free licence to:

  • view;
  • download;
  • copy;
  • store;
  • retain;
  • print;
  • share;
  • reproduce; and
  • use

the Content in connection with the event and related personal purposes.

This includes use in photo albums, slideshows, printed materials, invitations, thank-you cards, memory books, and similar event-related uses.

You also grant other event participants the right to view and access the Content within the event.

8. Event Content and Removal

Because onesnap is designed to preserve event memories, Content uploaded to an event may continue to be retained by the event host and other participants even if it is later removed from onesnap.

Removal requests relating to event Content should generally be directed to the event host.

onesnap is not responsible for resolving disputes between event participants regarding uploaded Content.

9. Host Rights and Responsibilities

Event hosts are responsible for managing their events.

Hosts may:

  • hide Content;
  • remove Content from an event;
  • pause uploads;
  • disable future uploads;
  • archive events;
  • close events;
  • cancel events; and
  • use other moderation tools provided by onesnap.

Hosts are also responsible for ensuring they have the right to contact people they invite to events and for complying with applicable privacy, anti-spam, and communications laws.

10. Prohibited Content and Conduct

You must not use onesnap to:

  • break the law;
  • infringe copyright or other rights;
  • harass, threaten, abuse, or intimidate others;
  • distribute malware or harmful software;
  • impersonate another person;
  • interfere with the operation or security of the Service;
  • upload content you do not have the right to share.

We may remove, restrict access to, or refuse to host any Content that we reasonably believe:

  • is unlawful;
  • infringes the rights of others;
  • creates a safety or security risk;
  • is inconsistent with the purpose of the Service; or
  • may expose onesnap or its users to harm.

11. Copyright Complaints

We respect intellectual property rights.

If we receive a valid complaint alleging that Content infringes copyright or other rights, we may investigate and remove the Content.

We may also remove Content where we reasonably believe infringement has occurred, even without receiving a formal complaint.

12. Suspension and Termination

We may suspend, restrict, or terminate access to onesnap, an account, an event, or any Content where we reasonably believe:

  • these Terms have been breached;
  • the Service is being misused;
  • the rights of others are affected; or
  • legal, security, operational, or safety concerns require us to do so.

Where appropriate, we may provide notice before taking action, but we are not required to do so.

13. Privacy

Your privacy is important to us.

Our collection, use, storage, and disclosure of personal information is governed by our Privacy Policy, which forms part of your use of onesnap.

By using onesnap, you acknowledge that we may collect and use information as described in our Privacy Policy.

14. Availability of the Service

We aim to provide a reliable service using reasonable care and skill.

However, we do not guarantee that onesnap will always be available, uninterrupted, secure, or error-free.

The Service may occasionally be unavailable due to:

  • maintenance;
  • technical issues;
  • internet outages;
  • third-party provider failures;
  • security incidents; or
  • circumstances beyond our reasonable control.

15. Event Storage

onesnap stores event content so that hosts and participants can access and share event memories through the Service.

While we take reasonable steps to maintain the availability of event content, we do not guarantee that any content will remain available for any particular period of time or that content will never be lost, damaged, corrupted, removed, or become inaccessible.

Users should maintain their own copies of important content.

16. Not a Professional Backup Service

onesnap is an event sharing and storage platform, not a professional backup, archival, or disaster recovery service.

You should not rely on onesnap as the sole location for storing important photos, videos, or other content.

We recommend that hosts and users keep their own copies of important content.

17. Event Deletion and Data Retention

When an event or account is deleted, Content may be removed from normal access immediately.

We may retain data for a limited period for backup, recovery, security, legal, operational, or compliance purposes before permanent deletion.

18. Limitation of Liability

To the maximum extent permitted by law:

  • onesnap is provided on an “as available” basis;
  • we are not liable for indirect, incidental, special, consequential, or punitive losses;
  • we are not liable for losses arising from user conduct, third-party services, internet failures, device failures, or unauthorised access.

Nothing in these Terms excludes, restricts, or modifies any rights or remedies that cannot be excluded under applicable law, including Australian Consumer Law.

Where liability cannot be excluded, our liability is limited to the maximum extent permitted by law.

19. Changes to the Service

We may modify, improve, discontinue, replace, or update any part of the Service from time to time.

We may also change features, functionality, storage limits, pricing, or access requirements.

20. Business Transfers

If Throwing Eights undergoes a merger, acquisition, restructuring, sale of assets, or other business transfer, we may transfer our rights and obligations under these Terms to the successor entity.

21. Changes to These Terms

We may update these Terms from time to time.

Updated Terms will be published on the onesnap website and will take effect when published unless otherwise stated.

Continued use of onesnap after updated Terms take effect constitutes acceptance of the updated Terms.

22. Governing Law

These Terms are governed by the laws of Victoria, Australia.

You agree to submit to the courts of Victoria, Australia, except where mandatory laws in your jurisdiction provide otherwise.
